Why attend?

The course aims to give construction professionals a better understanding of contract conditions and the legal framework within which they operate. It is particularly relevant to construction professionals who are interested in becoming adjudicators, arbitrators and mediators.

The course has been accredited by the Institution of Civil Engineers (ICE) and is often used as a pathway to ICE’s dispute resolution registers, including adjudicators, arbitrators and mediators.

Kai is a Solicitor-Advocate who advises clients on construction contracts and disputes. He serves on the committee of CIArb (Chartered Institute of Arbitrators) Western Counties and on the panel of specialist practice consultants for the RIBA (Royal Institute of British Architects). He regularly speaks at workshops run by CIArb and the Chartered Institute of Building (CIOB).

The course covers:

Contract Law

  • Formation of the contract
  • Terms of the contract (express and implied)
  • Excluding and limiting liability
  • Defects in construction
  • Misrepresentation
  • Privity of contract (third party rights and collateral warranties)
  • Assignment of the contract
  • Being an agent of a party to a contract
  • Frustration (as in the legal principle)
  • Breach of contract
  • Termination of the contract
  • Remedies/damages
  • Defences (contributory negligence)
  • Limitation (when claim becomes time-barred)


  • Vicarious liability (liability for your employees)
  • Negligence
  • Negligent misstatement
  • Nuisance (interference with property)
  • Rule in Rylands & Fletcher (strict liability when something dangerous escapes)
  • Occupier’s liability (dangerous premises)
  • Remedies/damages in tort
  • Defences (contributory negligence)
  • Limitation (when claim becomes time-barred)

The course is taught over 20 hours, from 2.30pm – 4.30pm on the following dates:

  • 26 September
  • 3, 10, 17 October
  • 7, 14, 21, 28 November
  • 5, 12 December

Course Fees

£325 + VAT for members of ICE, CIArb or CIOB,

£375 + VAT for non-members

Delegates will be able to sit the ICE exam after the course. Passing the exam will count towards achieving the ICE Certificate in Law and Contract Management (CLCM), which is often used as a pathway to ICE’s dispute resolution registers (including adjudicators, arbitrators and mediators). The exam is optional. Please get in touch with Kai von Pahlen at, if you are interested in sitting the exam.

Attending the course  will assist ICE members with their Chartered and Member Professional Reviews, particularly in developing their “Commercial Ability”. Delegates can request an attendance certificate, if required.

This course will be subject to a minimum number of bookings. We will confirm at the beginning of September 2022 if that number has been reached. Please do not book any travel or accommodation until this confirmation has been sent.
